The Supreme Court has given the Accra High Court the green light to proceed with the Skytrain trial after dismissing an injunction application filed by the first accused, Solomon Asamoah.
Sitting as a single Justice of the Apex Court on Monday, August 31, 2026, Justice Senyo Dzamefe ruled that Mr. Asamoah—the former Chief Executive Officer of the Ghana Infrastructure Investment Fund (GIIF)—failed to prove a serious case or demonstrate any irreparable harm that would occur if the trial continued.
Mr. Asamoah had sought an interlocutory injunction to halt proceedings while pursuing an order of certiorari aimed at overturning the High Court’s rejection of his “no-case” submission.
However, Justice Dzamefe noted that the applicant’s own affidavit failed to establish a serious case, adding that the trial court did not act beyond its jurisdiction and that the grievances raised belonged in a regular appeal rather than an injunction request.
With the injunction dismissed, the Accra High Court remains clear to continue hearing the case, having set September 23, 2026, as the final extended deadline for the accused persons to file their defence.
Meanwhile, a separate application for a stay of proceedings filed by the second accused—former GIIF Board Chairman Prof. Christopher Ameyaw Ekumfi—is slated for hearing at the Court of Appeal on September 1, 2026.
Both Mr. Asamoah and Prof. Ekumfi are currently standing trial over allegations of unapproved payments totaling $2 million connected to the Skytrain project.
